1. Scope of Application
1.1.
The following General Terms and Conditions (GTC) apply to all orders and deliveries between Maktabat Salsabeel (hereinafter referred to as the “Seller”) and the customer (hereinafter referred to as the “Customer”) in the version valid at the time of the order.
By completing the order, the Customer agrees to these GTC. The GTC can be accessed at any time via the Seller’s website.
1.2.
For questions, complaints, and claims, customer service is available at maktabat.salsabeel@gmail.com.
1.3.
Any deviating terms and conditions of the Customer shall not be accepted unless the Seller expressly agrees to their validity.
2. Offers and Service Descriptions
2.1.
The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. Product descriptions and images serve to present the respective products. Minor deviations in color, presentation, or design may occur due to technical circumstances.
2.2.
All offers are valid “while stocks last,” unless otherwise stated for the respective product. Errors and omissions excepted.
3. Ordering Process and Conclusion of Contract
3.1.
The Customer may select the products offered in the online shop without obligation and add them to the shopping cart using the “Add to cart” button. The product selection can be changed or removed from the shopping cart at any time.
The Customer can then continue the ordering process by clicking the “Checkout” button.
3.2.
By clicking the “Place order with obligation to pay” button, the Customer submits a binding offer to purchase the goods contained in the shopping cart.
Before submitting the order, the Customer can review and modify all order details. The ordering process can be canceled at any time before the order is submitted.
3.3.
After receiving the order, the Customer will receive an automatic confirmation of receipt by email. This confirmation merely confirms receipt of the order and does not yet constitute acceptance of the offer.
The purchase contract is concluded as soon as the Seller accepts the order by expressly confirming the order or ships the ordered goods.
3.4.
If an ordered product is not available, the Customer will be informed immediately. Any payments already made will be refunded immediately in this case.
4. Prices and Shipping Costs
4.1.
All prices stated in the online shop are in euros and include statutory VAT, insofar as VAT is applicable.
4.2.
In addition to the stated product prices, shipping costs may apply. The amount of the shipping costs will be displayed to the Customer during the ordering process before the order is completed.
5. Delivery and Product Availability
5.1.
The delivery time is stated on the respective product page or during the ordering process.
5.2.
If delivery of the goods is not possible despite reasonable delivery attempts for reasons for which the Customer is responsible, the Seller may withdraw from the contract, provided that the statutory requirements for this are met. Any payments already made will be refunded immediately in this case.
5.3.
If a product cannot be delivered due to an unforeseeable lack of availability for which the Seller is not responsible, the Customer will be informed immediately. In this case, the Seller is entitled to withdraw from the contract, provided that the statutory requirements for this are met. Any payments already made will be refunded immediately.
6. Payment Methods
6.1.
The Customer has access to the payment methods specified during the ordering process. The Customer will be informed of the payment methods available in each case and any applicable fees before completing the order.
6.2.
When using payment service providers, their respective terms of use and business terms and conditions shall also apply.
7. Retention of Title
The goods remain the property of the Seller until full payment has been received.
8. Liability for Defects and Warranty
8.1.
The statutory provisions regarding liability for defects shall apply.
8.2.
An additional warranty exists only if it has been expressly stated for the respective product. Any warranty conditions will be communicated to the Customer before the purchase contract is concluded.
9. Liability
9.1.
The Seller shall be fully liable for damages resulting from an intentional or grossly negligent breach of duty by the Seller, its legal representatives, or vicarious agents.
9.2.
The statutory provisions shall apply to damages resulting from injury to life, body, or health, as well as to claims under the Product Liability Act.
9.3.
In all other respects, the Seller shall only be liable in accordance with the statutory provisions.
10. Storage of the Contract Text
10.1.
The Seller stores the contract text in accordance with statutory requirements. The specific order details may be sent to the Customer by email after completion of the order.
10.2.
The Customer should save the order confirmation and the GTC applicable at the time of the order for their records.
The current GTC can be accessed at any time on the Seller’s website.
11. Right of Cancellation
The Customer generally has a statutory right of cancellation. Details are set out in the separate Cancellation Policy, which is made available to the Customer in the online shop.
The direct costs of returning the goods in the event of cancellation shall be borne by the Customer, provided that the Customer has been properly informed of this.
12. Copyright
12.1.
All content, texts, images, graphics, designs, and other content of the Maktabat Salsabeel online shop are protected by copyright unless otherwise indicated.
Any reproduction, modification, distribution, or making these contents publicly accessible requires the prior consent of the respective rights holder, unless permitted by law.
12.2.
The use of content from the online shop for private purposes is permitted within the scope of statutory provisions. Commercial use or redistribution is not permitted without the appropriate consent.
13. Final Provisions
13.1.
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), insofar as this does not conflict with mandatory statutory consumer protection provisions.
13.2.
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The statutory provisions shall replace the invalid provision.
